The text outlines the legal and political controversy surrounding the so-called Quasi-War of 1798–1801 between the United States and France, drawing particular attention to the usually overlooked records of Congressional debates. The text shows that the decision not to issue a formal declaration of war, although motivated by the political needs of the moment, significantly affected the constitutional practice of the United States, especially in the form of the de facto shift of the exercise of part of the constitutional powers of Congress to the President.
