The aim of this article is to analyze the political and legal situation of nicotine pouches (snus) imported to Poland from Scandinavian countries, mainly Sweden. The product itself is banned in the EU, but permitted in Sweden and Norway. It is also possible to import it to some countries for personal use. The analysis presents a general outline of the historical basis for the use of tobacco pouches, the evolution of the legal framework and the latest case law in response to tobacco producers’ demands for the legalization of snus. The article also addresses the issues of Polish policies aimed at so-called smokeless tobacco products. The paper argues that smokeless tobacco products should remain banned because they create artificial needs motivated by the interests of tobacco producers. Legislators should aim to ensure market balance so that the creative possibilities of a free economy realize the proper and real, pluralistic interests of all its participants.
